A few months ago a lawsuit was filed against Apple by a Swiss photographer who claimed that Apple misused one of her images. Most people are probably familiar with Apple’s “Retina” eyeball image that was used during one of Apple’s keynote presentations at WWDC last June. From the sounds of it, the lawsuit has been settled.
The Swiss photographer, Sabine Liewald, had complained that Apple misused her photo by including it in a promotion for its latest MacBook Pro with Retina display. Liewald argued that Apple had the rights to use the image of the model’s eye for “layout purposes only,” and not for commercial use.
News of the settlement came in a court-ordered dismissal dated for last Wednesday. Both parties were scheduled to meet for a pretrial conference today. Terms of the settlement are unclear and Apple has not responded for comment.
The suit was filed in the U.S. District Court for the Southern District of New York back in October and was looking for a trial by jury to determine damages and potential lost profits.
